1. Agreement and Scope
These Terms and Conditions (“Terms”) are an agreement between you and ARBITRARY ZEN, LLC (“ARBITRARY ZEN,” “we,” “us,” or “our”). They apply to skillhead.com, the Skillhead Android mobile game, and related features and services we provide together (the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
The Services are intended for people age 13 or older. If you are under the age of legal majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian. A parent or guardian who permits a minor to use the Services is responsible for that minor’s use.
3. License to Use Skillhead
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Skillhead on a compatible device for personal, non-commercial entertainment.
You do not acquire ownership of Skillhead or any content within it. All rights not expressly granted in these Terms remain with ARBITRARY ZEN and its licensors.
4. Player Accounts
Some Skillhead features use an email address and service-generated account or player identifiers. You agree to provide accurate information, keep access to your account secure, and notify us if you believe your account has been accessed without permission. You are responsible for activity occurring through your account unless applicable law provides otherwise.
Account and personal-information handling is explained in our Privacy Policy, including how to request account or data deletion.
5. Cloud Saves, Leaderboards, and Multiplayer
Skillhead uses Unity Gaming Services for cloud saves and leaderboards and Photon for online multiplayer. Online features require a compatible device and internet connection and may depend on third-party service availability.
You agree to play fairly. We may correct or remove leaderboard entries, invalidate results, restrict online features, or suspend an account when we reasonably believe cheating, exploitation, manipulation, abuse, or a violation of these Terms has occurred.
6. Acceptable Use
You may not:
- Use the Services for unlawful, fraudulent, abusive, or harmful activity
- Cheat, exploit bugs, manipulate scores, use unauthorized automation, or interfere with fair competition
- Harass, threaten, impersonate, or attempt to harm another player or person
- Disrupt servers, networks, accounts, security systems, or another person’s use of the Services
- Introduce malware, scrape protected information, probe for vulnerabilities, or bypass access controls
- Reverse engineer, decompile, disassemble, modify, or create derivative works from the Services except where applicable law expressly permits it
- Copy, sell, rent, sublicense, distribute, or commercially exploit the Services or their content without our written permission
- Infringe intellectual-property, privacy, or other legal rights
7. Intellectual Property
Skillhead, the website, game design, characters, artwork, music, sound recordings, software, code, text, logos, product designs, and other original materials are owned by or licensed to ARBITRARY ZEN and are protected by intellectual-property laws. These Terms do not grant permission to use our names, trademarks, logos, artwork, music, or other content outside the limited personal use of the Services.
If you believe content within the Services infringes your copyright or other rights, contact us with enough information to identify the work, the material at issue, your contact information, and the basis of your claim.
8. Feedback
If you voluntarily send us ideas, suggestions, or feedback about the Services, you grant us permission to use that feedback without restriction or compensation to you. Please do not send confidential information or ideas you do not want us to use.
9. Third-Party Services
The Services use or link to third-party platforms, including Google Play, Firebase, Unity Gaming Services, Photon, WooCommerce, Square, Formspree, Bandcamp, Instagram, and TikTok. Those services are operated by their respective providers and may be governed by separate terms and privacy policies. We are not responsible for third-party services, content, availability, or practices.
10. Google Play
Skillhead is distributed through Google Play. Your use of Google Play is also governed by the Google Play Terms of Service. Google Play may provide updates, enforce platform requirements, or change the availability of the app independently of ARBITRARY ZEN.
11. Merchandise and Store
Product descriptions, images, prices, and availability may be corrected or changed at any time. Colors and appearance may vary by screen or production process. Adding an item to the website cart does not reserve the item or complete a purchase.
An online order is not accepted until payment is successfully processed and the order is confirmed. Payments are processed through Square. We may cancel or limit an order because of inventory errors, pricing errors, suspected fraud, shipping restrictions, or other reasonable business concerns. Physical-merchandise returns are governed by our Refund and Returns Policy.
12. Privacy
Our Privacy Policy explains how information is collected, used, shared, retained, and protected across the website and Skillhead mobile app. By using the Services, you acknowledge that you have reviewed that policy.
13. Updates, Availability, and Saved Data
We may add, change, update, suspend, or discontinue any part of the Services. Updates may be required for security, compatibility, bug fixes, or new features. We do not guarantee that every feature, device, online match, leaderboard, cloud save, or third-party integration will always be available or error-free.
We take reasonable steps to maintain online data, but technical failures may occasionally cause lost or corrupted progress, scores, settings, or saved information. Where the app provides a way to maintain a local copy or backup, you are responsible for using it.
14. Suspension and Termination
You may stop using the Services at any time. We may restrict or terminate access to accounts or online features when reasonably necessary to address violations of these Terms, cheating, fraud, abuse, security risks, legal requirements, or harm to the Services or other users.
Termination ends the license granted under these Terms. Provisions concerning ownership, disclaimers, liability, disputes, and any terms that logically should survive will continue to apply.
15. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not promise that the Services will always be uninterrupted, secure, error-free, compatible with every device, or free from data loss. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent those disclaimers are permitted by law.
Nothing in these Terms limits warranties or consumer rights that cannot legally be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, ARBITRARY ZEN and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or game progress arising from or related to the Services.
To the fullest extent permitted by law, our total liability for a claim related to the Services will not exceed the amount you paid directly to ARBITRARY ZEN for the product or service giving rise to the claim during the 12 months before the event that created the claim. These limitations do not apply to liability that cannot legally be limited or excluded.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where the mandatory laws of your place of residence apply.
Before filing a formal claim, you agree to contact us and give both sides a reasonable opportunity to resolve the dispute informally. If a dispute cannot be resolved, it may be brought in a court with jurisdiction serving Clermont County, Ohio, unless applicable consumer law allows or requires another location. Either party may bring an eligible claim in small-claims court.
18. Changes to These Terms
We may update these Terms when the Services, our business, or applicable requirements change. The effective date at the top of this page identifies the latest revision. If a change is material, we may provide additional notice through the website, the app, or another reasonable method. Continuing to use the Services after updated Terms become effective means you accept the revised Terms.
19. General Terms
These Terms, together with the policies linked above, form the agreement between you and ARBITRARY ZEN concerning the Services. If one provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our permission; we may transfer our rights and obligations as part of a merger, acquisition, reorganization, or sale of assets.
